"Property Owner" refers to the legal owner of a rental property listed through our services.

"Agreement" refers to these Terms and Conditions together with any lease agreements and service contracts entered into between parties.

2. Acceptance of Terms

By accessing our website or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.

These terms constitute a legally binding agreement between you and Brevanta. Your use of our services confirms your acceptance of these terms and your commitment to comply with them.

You must be at least eighteen years of age to use our services. By using our services, you represent and warrant that you are of legal age to form a binding contract under Malaysian law.

3. Service Description

Brevanta provides property rental assistance services in Kuala Lumpur, Malaysia. Our services include property search and matching, viewing coordination, property assessment reports, lease term negotiation support, and ongoing tenant assistance throughout the rental period.

We act as intermediaries between property owners and prospective tenants. We do not own the properties we present and are not responsible for property conditions beyond the scope of our assessment services.

Service availability may vary based on property inventory and market conditions. We reserve the right to modify or discontinue services with notice to affected clients.

4. Client Responsibilities

4.1 Information Accuracy

You are responsible for providing accurate, complete, and current information when using our services. This includes personal details, financial information, rental history, and property preferences. You must notify us promptly of any changes to the information you have provided.

4.2 Property Viewings

When attending property viewings, you agree to treat properties with respect, comply with viewing schedules and arrangements, follow any specific property rules or requirements, and notify us promptly if you cannot attend a scheduled viewing.

4.3 Lease Obligations

If you enter into a lease agreement for a property found through our services, you are responsible for complying with all lease terms, making timely rent and deposit payments, maintaining the property in good condition, and adhering to property owner rules and regulations.

4.4 Prohibited Conduct

You agree not to provide false or misleading information, use our services for unlawful purposes, interfere with property viewings or negotiations, bypass our services to deal directly with property owners after initial introduction, or misrepresent your identity or relationship with other parties.

5. Service Fees and Payments

5.1 Fee Structure

Our service fees are disclosed to clients before any service agreement is finalized. Fees may vary based on property type, lease duration, and specific services requested.

5.2 Payment Terms

Payment terms are specified in individual service agreements. Fees are typically due upon successful lease execution unless otherwise agreed in writing.

5.3 Rental Payments

Rental payments, security deposits, and utility deposits are paid directly to property owners or their designated agents according to lease agreements. We do not collect or hold tenant rental payments except in specific circumstances disclosed in advance.

5.4 Refunds

Service fees are generally non-refundable once services have been provided. Refund eligibility, if any, will be determined based on the specific circumstances and stage of service delivery.

6. Property Information and Assessments

6.1 Information Accuracy

We make reasonable efforts to provide accurate property information based on our assessments and data from property owners. However, property conditions may change, and we cannot guarantee absolute accuracy of all details.

6.2 Independent Verification

We encourage clients to conduct their own property inspections and due diligence. Our assessment reports are intended to assist your decision-making process but should not replace your own evaluation.

6.3 No Guarantees

We do not guarantee specific property availability, lease approval, or any particular outcome from using our services. Lease decisions rest with property owners, and we cannot control their selection criteria.

7. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Brevanta or its content suppliers and is protected by Malaysian and international copyright laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes related to our services. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from our website without our prior written consent.

Property reports and documents we provide are for your personal use in connection with rental decisions and may not be shared with third parties or used for commercial purposes without authorization.

8. Disclaimers

8.1 Service Provision

Our services are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding service availability, accuracy, reliability, or fitness for a particular purpose.

8.2 Professional Advice

The information and services we provide do not constitute legal, financial, or professional advice. You should consult appropriate professionals regarding lease agreements, financial commitments, and legal matters.

8.3 Third-Party Interactions

We are not responsible for the actions, omissions, or conduct of property owners, other tenants, service providers, or any third parties you interact with through our services.

9. Limitation of Liability

To the maximum extent permitted by Malaysian law, Brevanta shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for any claims arising from our services shall not exceed the total fees paid by you to us in the six months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Brevanta, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from your use of our services, violation of these Terms and Conditions, infringement of any third-party rights, or any breach of lease agreements entered into through our services.

This indemnification obligation will survive termination of your use of our services.

11. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, with or without notice, for conduct that we believe violates these Terms and Conditions, is harmful to other users, property owners, or third parties, or is otherwise contrary to our business interests.

You may terminate your use of our services at any time by notifying us in writing. Termination does not relieve you of any obligations incurred prior to termination.

Upon termination, your right to use our services will immediately cease. Provisions of these Terms and Conditions that by their nature should survive termination shall survive.

12. Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

These Terms and Conditions, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and Brevanta regarding our services.

13.2 Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms and Conditions or your rights under them without our prior written consent. We may assign our rights and obligations under these terms without restriction.
